The Dayton Area Chamber of Commerce, the largest chamber in the Dayton region, along with the Ohio Chamber of Commerce, the Michigan Chamber of Commerce and the U.S. Chamber of Commerce, filed a lawsuit against federal entities the Centers for Medicare and Medicaid (CMS) and Health and Human Services (HHS) to protect the rights of businesses in the pharmaceutical industry.
The filing with the U.S. District Court for the Southern District of Ohio, Western Division, states that the federal law allowing CMS and HHS to arbitrarily set prices on prescription drugs without sufficient legal safeguards is unconstitutional, and that it oversteps core provisions in the Constitution that protect private business from government overreach.
“The Dayton Area Chamber of Commerce has various members across the supply chain that are impacted by this federal law. While we would all like to see a market-based reduction in prescription drug prices, the government should not be price setting for private industry,” explained Chris Kershner, president and CEO at the Dayton Area Chamber of Commerce. “We feel that this filing was a natural course of action to protect the rights of our business community. We were pleased that the U.S. Chamber of Commerce, the Ohio Chamber of Commerce, and the Michigan Chamber of Commerce have joined together in support of this pro-business filing.”
